Gay Marriage challenge from France: The Court of Cassation to the Constitutional Council

Today the Court of Cassation went before the EU Constitutional Council over the issue of gay marriage, now banned in France.
 
On August 24th, the Tribunal de Grande Instance de Reims sent a Question of Constitutionality priority to the Court of Cassation on articles 75 and 144 of the Civil Code, which prohibit marriage for same-sex couples.
 
For applicants, those sections of the civil code are unconstitutional in that they "prohibit the personal freedom of a French citizen from marrying someone of the same sex."
 
In a ruling Tuesday, the First Civil Chamber of the Court of Cassation held that the issue of gay marriage was "new" and "serious" and "now the subject of wide debate in society, particular because of changing mores and the recognition of marriage between same-sex legislation in several foreign countries."


"This decision of the Court of Cassation is good news for the three million lesbians and gays who can not marry," welcomed the Mécary Carolina lawyer who has defended numerous cases of this type.
 
"Hopefully soon France will respect the principle of equal treatment, by opening marriage to couples of the same sex, which has already been done now in eight European countries (Netherlands Belgium, Spain, Norway, Sweden, Portugal, Iceland, United Kingdom)
